An employee wants to lease an e-bike through their mobility budget. A colleague already leases a bike through a cafeteria plan and now wants to exchange their company car for a mobility budget.

Are both combinations allowed?

Yes, bike leasing can be combined with Belgium’s statutory mobility budget. The key distinction is whether the lease is funded within the budget or provided separately. Different conditions apply.

Can employees lease a bike through their mobility budget?

Yes. Bike leasing is an eligible expense under pillar 2 of the Belgian statutory mobility budget, provided the employer offers it and the legal conditions are met.

City bikes, e-bikes, folding bikes and cargo bikes can qualify. Check the technical requirements too, particularly for speed pedelecs and other motorised vehicles.

Set out how employees request a bike, which suppliers they can use and how the costs are charged.

How are bike costs deducted from the budget?

The treatment depends on who buys the bike and how it is financed:

  • Leasing: lease payments are charged according to the applicable contractual and legal rules.
  • Purchase by the employee: the purchase cost cannot simply be spread across several budget years.
  • Purchase by the employer: when the employer buys the bike and makes it available, depreciation over its useful economic life may be possible under the applicable conditions.

For a lease with a purchase option, also check how the final purchase price would be processed.

A simple example

An employee has an annual mobility budget of €8,000. A lease charged at €100 a month for a full year uses €1,200, leaving €6,800 before other spending or adjustments.

This is a simplified example. Confirm the full cost, including VAT treatment, maintenance, insurance, administration and any purchase option.

Can an existing company bike stay outside the mobility budget?

Sometimes, but an ongoing lease alone does not preserve the tax and social security exemptions.

An exception may apply if the employee already combined the exempt company bike with a company car, or entitlement to one, for at least three months immediately before applying for the mobility budget.

The arrangement must also have met the relevant exemption conditions at that time. Check the benefit itself, commuting use and previous payroll treatment, alongside the dates.

Have payroll confirm the exception and document it in the mobility budget agreement.

What if the bike lease is funded through salary sacrifice?

A lease funded through gross salary exchange does not automatically follow the same rules as a lease funded under pillar 2.

Before continuing an existing arrangement, review the salary sacrifice agreement, company bike conditions, commuting use, application date and earlier payroll treatment.

Starting a new cafeteria-plan bike lease after the statutory mobility budget has begun does not automatically preserve the exemptions.

Can employees also receive a cycling allowance?

Yes, subject to the applicable conditions. Check the allowance separately from the bike.

An eligible cycling allowance can be funded within pillar 2. Paying it separately with its exemptions requires an applicable legal exception.

An existing company bike does not automatically justify an additional exempt cycling allowance. Check whether the employee actually received that allowance before applying. Having cycled to work is not enough by itself.

What happens if the budget becomes insufficient?

A departure or another change affecting entitlement can leave too little budget to cover the lease.

Any shortfall must be repaid or processed as a salary benefit, with the applicable taxes and social security contributions. Ask payroll to confirm the treatment.

Ending the mobility budget does not necessarily end the lease contract. Check separately which payments remain contractually due and which costs can still be charged to the budget.

Agree upfront on returns, transfers and early termination costs.

What should HR check before approving the lease?

Confirm the funding route, any exemption for an existing bike, the full cost and the arrangements for departures or shortfalls.
